We provide the general contracting conditions (hereinafter, “GTC” or “General Contracting Conditions”) that regulate the conditions for booking and contracting the activities and experiences offered by BASECAMPS CERDANYA, SL, with NIF: B67157073 and registered office at C/Ríos Rosas 41 08006 Barcelona (hereinafter “BASECAMPS”), through the Website www.basecamps.com (hereinafter, the “Website”).
BASECAMPS CERDANYA reserves the right to change these GTC and the specific conditions for contracting certain products or services at any time, so it is the user’s responsibility to review these before contracting products or services available on the Website.
By accessing, viewing, or using the materials, content, or services accessible through the Website, the User acknowledges that they understand and accept these General Terms of Use (hereinafter, the “General Terms”), which define the rights and obligations of BASECAMPS and the User for the contracting of activity and/or experience services.
These are the only General Terms applicable to the use of the Website (without prejudice to the existence of specific conditions for certain services) and to the contracting of services, and they replace any other conditions, except by prior written agreement between BASECAMPS and the User.
Access to the Website does not require user registration. However, to be able to contract the services offered by BASECAMPS, the acceptance of these General Terms will be required before formalizing the corresponding reservation and/or payment.
To make reservations through the Website, the User must provide their personal data (name, surname, email, and phone number), or, if applicable, the data of the person on whose behalf the activity and/or experience is reserved, so that BASECAMPS can make the reservation requested by the User.
The User declares that they are of legal age (over 18 years old) and have the necessary legal capacity to contract the activities and/or experiences offered by BASECAMPS through the Website according to the conditions outlined in these GTC, which they declare to understand and accept. The User is solely responsible for the truthfulness and accuracy of the data provided in the reservation process.
By virtue of these General Terms, Users declare to provide true, accurate, current, and complete data about their identity, or, if applicable, about the person on whose behalf the activity and/or experience is reserved. In this regard, Users will be responsible for the accuracy of the data provided to BASECAMPS and any consequences that may arise from errors in the information provided.
BASECAMPS CERDANYA is not responsible for not receiving the activity reservation if the email address configuration is incorrect or if incorrect information has been provided. Additionally, you must inform immediately if there is any change related to your email address or phone number.
Reservations made by each User through the Website are subject to the specific conditions applicable to each activity and/or experience. The User can find these conditions in the description sheet on the Website for each of these services, as well as in the confirmation email sent by BASECAMPS once the reservation has been made.
In general, the reservation of activities and/or experiences promoted by BASECAMPS through the Website is subject to the following conditions:
The dates and times of the activities and/or experiences published on the Website have been pre-established and do not allow for any modifications in this regard. The only possibility to modify the date and time of an activity and/or experience exists if the User has contracted a private service, in which case they must address this issue directly by sending an email to experiences@basecamps.com.
Users can modify the details of their reservations as long as the conditions of the activity and/or experience allow. To make this modification, the User must directly send an email to experiences@basecamps.com.
The minimum advance time for each reservation varies depending on the activity and/or experience to be reserved. This specific aspect can be seen in the sheet of the respective activity and/or experience on the Website. BASECAMPS informs that it is not possible to reserve an activity and/or experience with an advance time less than indicated in the activity sheet.

The meeting point, date, time, duration, and all necessary information for the enjoyment of the reserved activity and/or experience are detailed in the description sheet of each service on the Website, as well as in the confirmation email sent by BASECAMPS to the User once the reservation has been made.
In the confirmation email, in addition to providing all the information about the reserved service, BASECAMPS may provide the User with a reservation voucher for the contracted activity and/or experience.
It is essential that Users are punctual and present themselves at the meeting point at the time and date indicated on their voucher, as all activities and/or experiences are scheduled to start at a specific time and it is not possible to modify the start time.
The duration of the activities and/or experiences published on the Website is referential and could undergo slight variations depending on the development of the service itself, or due to any external factors such as weather conditions, traffic issues, strikes, etc.
If, once at the destination, Users have any questions related to the reserved service, and in particular, with the meeting point of the activity and/or experience, they can contact BASECAMPS at the contact phone number provided in the email that BASECAMPS sent at the time of confirming the reservation.
BASECAMPS informs that it may be required to show the email that confirms the reservation of the activity prior to its start. BASECAMPS assumes no responsibility if the User does not present this voucher before the activity and/or experience.
The contracting of the reservation of BASECAMPS services will be considered formalized once Users have completed and accepted the activity and/or experience reservation form and the same has been confirmed, after correctly completing the reservation process and correctly making the payment.
PAYMENT METHOD, PRICE.
The prices will be those indicated by BASECAMPS at the time of booking the activity and/or experience.
All services are of immediate confirmation and are paid at the time of reservation via credit or debit card (Visa or Mastercard).
The reservation amount will be charged to your card, so you will need to provide the number, expiration date, and security code. These data will not be stored or handled by us, but will be recorded directly in the payment gateway of the corresponding financial entity. The charge will be carried out in real-time through this Redsys payment gateway. In the event that the charge cannot be made (for any reason), the order will be automatically canceled.
In general, BASECAMPS collects the full payment through the Website for the activity and/or experience reserved by the User.
These prices are expressed in Euros (€) and the total amount will be indicated at the time of the final confirmation of the contracting of the activity and/or experience.
After contracting the reservation, Users will receive a confirmation email confirming the charge for the contracted activity and/or experience and providing a purchase receipt. The User should note that this purchase receipt does not equate to the issuance of the invoice corresponding to the reservation of the activity and/or service. The User can request the invoice once the reservation has been formalized through the Website.
The User can download the documentation regarding the contracting of the services provided by BASECAMPS. In the event that the reservation is canceled as indicated in section 7 of these General Terms, BASECAMPS will proceed to issue the appropriate rectifying documents for the User.
Any improper or fraudulent charge on the card used for the purchase must be notified to BASECAMPS through the email experiences@basecamps.com as soon as possible so that BASECAMPS can take the appropriate measures.
Activities and/or experiences reserved through actions or transactions with signs of being fraudulent may be canceled by BASECAMPS.
BASECAMPS reserves the right to cancel or reschedule activities and/or experiences due to adverse weather conditions (storms, snow, etc.) or force majeure to ensure the safety and quality of the activity for Users. In this case, BASECAMPS undertakes to notify any cancellation at least 2 hours in advance, via email, phone call, or text message.
Activities and/or experiences canceled due to bad weather can be rescheduled for the day and time mutually agreed upon by the user and BASECAMPS at no additional cost and whenever possible. If it is not possible to reschedule the canceled activity and/or experience, BASECAMPS will refund the user the full price.
Users agree to make lawful, diligent, honest, and correct use of any information or content they access through the Website, and all under the principles of good faith and always respecting the current legality and these General Terms. In particular, but not limited to, Users must not:
BASECAMPS also reserves the right to notify the competent authorities of any suspicion of illegal activities on its Website, as well as to remove or block any User that BASECAMPS considers, or has founded suspicions, is carrying out or has carried out any activity that goes against the law, morality and/or public order as well as in any other way spreading, sharing, storing or distributing illegal content or that, even if lawful, such sharing, storage or distribution occurs in any unlawful manner.
Pursuant to Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a single market for digital services and amending Directive 2000/31/EC (Digital Services Regulation), in the event that BASECAMPS considers that the User has violated any section of these General Conditions, as well as any of its internal policies or procedures and decides to take the decision to: a) Remove information or block access to it or restrict its visibility; b) Suspend or terminate the provision of the service; c) Suspend or delete the User’s account; d) Suspend, terminate or otherwise restrict the ability to monetize the information provided by the User, BASECAMPS will accompany the notification with a statement of reasons explaining to the User the infringement committed, the principle violated, and the possibility of appealing the decision through the BASECAMPS Internal Complaint Management System. The User will have a period of six (6) months to submit their statement free of charge via email experiences@basecamps.com.
Users who have booked activities and/or experiences through BASECAMPS may post their reviews and ratings on the Website.
To do so, BASECAMPS will send an email to the User, when the activity and/or experience have been completed, so that they can rate the experience.
When BASECAMPS receives the User’s review and rating, it will review and publish it as soon as possible on the Website.
In any case, BASECAMPS will publish the User’s reviews provided that the content is not false, illegal, obscene, abusive, threatening, defamatory, invades the privacy of third parties, or is otherwise objectionable to third parties, and provided that the content does not incorporate advertisements or links to other websites and/or the review does not correspond to the service being reviewed.
In particular, BASECAMPS reserves the right not to publish reviews that may include the following terms:
Communications between BASECAMPS and Users will be conducted in writing via email with acknowledgment of receipt or by any other means that records the receipt and content of the communication.
Without prejudice to the responsibility for services applicable as established in the General Law for Consumers and Users, and by way of example but not limited to, BASECAMPS is not responsible for the following circumstances:
We inform you that the data provided for contracting our services will be processed by BASECAMPS as the data controller in accordance with Regulation (EU) 2016/679, of April 27, 2016, of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (hereinafter “GDPR”) and Article 11 of Organic Law 3/2018, of December 5, on the Protection of Personal Data and the guarantee of digital rights (hereinafter “LOPDGDD”).
Your data will be processed in order to execute the contract and, therefore, manage the service, collection and processing, make the corresponding billing and send you information about our services unless you express your opposition. You can unsubscribe from our commercial communications at any time through the option included when we send them to you. We will also process the data to comply with our legal obligations.
The legal basis for processing your data is the development and execution of the sales contract, legal obligations and the legitimate interest concerning the information we send you about our services.
We will retain your data during the maintenance of the contractual relationship and the legally established period to cover our responsibilities and comply with our legal obligations.
Additionally, BASECAMPS informs you that your data will be processed according to the purposes and the legal basis that enable us to do so as indicated below:
Your data will be communicated to third parties and bodies when necessary for the execution of the contract; in compliance with legal obligations; or to comply with requirements from authorities or judicial bodies, in any case for the exercise of their legitimate competencies.
We have service providers who may need access to your personal data to provide services. BASECAMPS has the corresponding data processing contract with these providers in accordance with Articles 28 and 29 of the GDPR. In some cases, personal data may be accessed by providers outside the territory of the European Union; in this case, BASECAMPS will ensure that data processing is protected with the appropriate guarantees according to the GDPR.
You have the right to access your personal data being processed, as well as to request the rectification of inaccurate data or, where appropriate, request its deletion when the data is no longer necessary for the purposes for which it was collected, in addition to exercising the right to object, portability, limitation to processing and revocation of your consent. In accordance with image rights regulated by Law 1/1982, of May 5, on the right to honor, personal and family privacy, and one’s own image and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. The User may appear in images taken during the activity and/or experience by different means for subsequent dissemination for promotional or advertising purposes. If the User is an adult, under their own name, and if a minor, also under the name of their parent/guardian, they expressly and gratuitously authorize:
13. NULLITY OF CLAUSES
If any clause included in these GTC is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will only affect that provision or the part of it that is null or ineffective, with the general conditions remaining in all other respects, and such provision, or the part of it that is affected, will be deemed not to be in place.
In the event that either Party does not exercise the rights that assist it in the event of non-compliance by the other Party with any of the obligations imposed on it by these GTC, it will not be interpreted as a waiver for future non-compliance with the obligation in question.
The User accepts that the applicable legislation to the operation of this service is Spanish. The Judges and Courts of the user’s domicile will be competent to hear the divergences arising from the interpretation or application of this clause.
